INTRODUCTION
Plaintiffs, who operate a.restaurant in the City of Rochester, commenced this ¿ction pursuant to 42 U.S;C. § 1983 after the defendant City of Rochester Planning Commission restricted their ability to *418present live outdoor amplified music. Now before the Court is Defendants’ motion (Docket.'No., [#6]) to dismiss the action pursuant to Federal Rule of Civil Procedure 12(b)(6). The application is granted.
