This action is to recover upon an employer’s accident insurance policy, designated as “an elevator liability policy,” issued by the defendant in error to the plaintiff in error.

The complaint alleges that at a time within the life of said policy one of his employes, Henry Gitzen, while in an elevator well or hoist-way of an elevator upon the premises described in the policy, and to which said policy relates, sustained bodily injuries from which he immediately died.
