About 100 yards from the Mayesvi'lle road on Chapman’s mountain, in Madison county, the arresting officers found this appellant and a negro woman, “in a -little thicket,” on a certain Sun-, day in October, 1924. There was evidence tending to show that this appellant was lying down.with his coat off, and that so-me 2- or 3 feet from him there was a bottle of whisky under his- coat.
