MEMORANDUM OPINION

ROYCE C. LAMBERTH, Chief Judge.

Defendant Federal Bureau of Prisons (“BOP”) moves to dismiss this action, to transfer or, in the alternative for summary judgment. ECF No. 38. Upon consider-, ation of the motion, plaintiffs Opposition [65], BOP’s Reply [72], the entire record herein, and the applicable law, the Court will deny BOP’s motion.

I. BACKGROUND
