MEMORANDUM OPINION AND ORDER

HOLWELL, District Judge.

Plaintiff brought this action pursuant to 42 U.S.C. § 1983 against the City of New York, the New York City Department of Corrections, and New York State Parole Officer Flinora Pough, alleging false imprisonment and due process violations. Defendants City of New York and the New York City Department of Corrections previously moved for summary judgment.
