ORDER
KAPLAN, District Judge.
Plaintiff brought this action against defendant Amalgamated Lithographers of America, Local One, for racial discrimination and retaliation in violation of Title VII of the Civil Rights Act of 1964, as amended. Defendant has moved for summary judgment dismissing the complaint.
In a report dated December 19,1997, Magistrate Judge Andrew J. Peek recommended that defendant’s motion be granted in part and denied in part. He concluded that the retaliation claim is time barred and that plaintiffs claim that the union violated Executive order. 11246 fails to state a claim…
