Appeal from a judgment of the Supreme Court (Malone, Jr., J.), entered September 20, 2004 in Greene County, upon a decision of the court in favor of defendant Randhir Jhamb.
This action sought to enjoin the use of a driveway by defendant Randhir Jhamb (hereinafter defendant), which crosses *569plaintiffs property. Defendant owns a .755-acre parcel which abuts plaintiff’s .366-acre parcel.
