Introduction
Plaintiff H. Clair Cheirett commenced this adversary proceeding against Defendant James Robert Biggs alleging that a debt owed to him under a state court money judgment is excepted from discharge in Defendant’s bankruptcy case under § 523(a)(4).1 Dkt. No. 1. To that end, Plaintiff filed a motion for summary judgment—the subject of this decision. Dkt. No. 12.
