*506This is a proceeding in mandamus. Plaintiff made application for an original writ of mandamus to issue from this court commanding the defendant P. C. Evans, as district judge of Salt Lake county, to proceed to rule and take such steps as may be necessary to bring a certain cause to trial brought by the plaintiff in said court against the defendants Utah Copper Company and Charles Shaw. An alternative writ was issued. The defendants have appeared and filed herein a general demurrer, return, and answer to the plaintiff’s application.
