BAKER, District Judge.

This matter is before the court on the parties’ cross motions for summary judgment. The plaintiff United States Equal Employment Opportunity Commission (“EEOC”) brings this suit for damages against the State of Illinois pursuant to Section 7(b) of the Age Discrimination in Employment Act of 1967 (“ADEA”), as amended, 29 U.S.C. § 621, et seq., which incorporates by reference Section 17 of the Fair Labor Standards Act of 1938 (“FLSA”), as amended, 29 U.S.C. § 217.
