Appellee sued appellant, to recover damages for personal injuries, alleging in effect that appellee having purchased at Corsicana a ticket entitling him. to. passage over .appellant’s road to the town of Dawson, and while attempting to board a train the brakeman cursed and abused him, grabbed him by the arm, and jerked him from the steps of the train, causing him to fall, injuring his back, etc. Appellant denied the allegations, and further pleaded contributory negligence, in that appellee had a grip in each hand and was unable to protect himself from injury in falling.
