The first question presented by the record is: Did Alexander Ilays have a right to apply for a writ of error to this court from the decision of the circuit court ? If he did not have the right, we must quash this writ, of error as improvidently awarded. It is well settled, that a person, who is not a party to- the procediugs in the court below, in which the judgment complained of was rendered, can not obtain a writ of error from this Court to the judgment of the court, below.
