Lovins, Judge:

This writ of error was granted to review an order of the Circuit Court of Cabell County, which dismissed an election contest on the ground that the County Court of Cabell County was without jurisdiction to proceed further therein.

R. W. Nelson was the nominee of the Republican- party arid T. Henry Nash was the nominee of the Democratic party for the office of Commissioner of the County Court of Cabell County, and they were voted for at the general election on November 3, 1942.
