McKinstey, J.:
William C. Hinckley, a citizen of California and resident of the City and County of San Francisco, died in that city and county on the 11th day of April, 1876.
On the 29th day of December, 1875, he had executed and published his last will and testament, which contained the following clauses:
“ 1. I give the property known as the California Theater property, being the property now subject to a lease to H. P. Wakelee, of the City of San Francisco aforesaid, which said lease is recorded in the Registry of Deeds at said San Francisco, liber 28, Leases, page 172, to which reference is…
