This case involves a claim for damages under the Oregon Residential Landlord and Tenant Act (RLTA), ORS 90.100 et seq. (1991). The issue is whether a tenant, who seeks damages for an alleged violation of the RLTA’s habitability requirements, must prove that the landlord knew or should have known of the alleged violation. The circuit court concluded that the tenant must prove that the landlord knew or should have known of the violation.
