PETERS, District Judge.

The case was heard on the petition for a writ of habeas corpus. The following are the facts: The petitioner is a seaman, second class, in the U. S. Navy, having enlisted January 6, 1942, for a period of six years. On June 30, 1942, while serving on detached duty as a member of the armed guard crew on the Motor Ship Baltic, under the command of a Lieutenant of the Naval Reserve, the ship being then moored to the dock at Montevideo, Uruguay, the petitioner, while intoxicated, shot and killed the chief officer of the ship.
