Burch, J.:

The action was one of bastardy. The defendant was acquitted and the state appeals.

The relatrix lives at Lindsborg. The defendant lives at McPherson. On November 11, 1914, the relatrix wrote a letter to the defendant, stating, among other things, that she was in trouble, that the defendant was to blame, and calling to his attention a time when the defendant was at Lindsborg the week after Easter Sunday.
