Construction is sought as to three independent provisions of the will of Emanuel Walter, deceased, the matter in controversy being contained in the twenty-eighth, forty-second and forty-third clauses.

It appears that the testator, who was unmarried, resided in the city of San Francisco, California, during all the years of his active business life; that he amassed a substantial fortune, and in the year 1894 he left San Francisco, never to return; that he was a native of Germany, and during the interval between his departure from San Francisco and his death, in 1905, he spent much of his time in…
