Appeal by the People from an order of the Supreme Court, Kings County (Ramirez, J.), entered September 22, 1981, which, upon defendant Morgan’s motion to dismiss indictment No. 3015/80, dismissed said indictment as to all five defendants named therein. H Order reversed, on the law, motion denied, indictment reinstated, and matter remitted to the Supreme Court, Kings County, for further proceedings. 11 Defendants were charged with criminal possession of a weapon in the third degree (Penal Law, § 265.02).
