Duttkin v. Zalenski

New Jersey Court of Chancery

Decided January 5, 1945No. Docket 148/174PublishedCited by 3 opinions

1Opinion of the Court

The defendants Carrie and Tony Zeltorowicz seek an order striking out the answer and counter-claim of their co-defendant, Michalina Zalenski, executrix of the estate of Stanley Luzinski, deceased.

It is at once observed that the answer of the co-defendant is solely responsive to the charges of the bill of complaint. It is not pointed at the defendants who now undertake to impugn its sufficiency. The motion in so far as it is addressed to the answer of the co-defendant is misconceived and must be denied.Second Workingmen's Building and Loan Association v. Wickers,83 N.J. Eq. 397; 91 Atl.
