This is an appeal from an order of the lower court denying petitioner’s application for a writ of habeas corpus.

The facts, as disclosed by the record before us, are as follows:

Petitioner, a member of the colored race, was convicted of three counts of burglary in Washington county, Mississippi, on February 2, 1946, and was sentenced to confinement in the Mississippi state penitentiary for five years on each count, the sentences to run consecutively.
