JAMESON, District Judge.

In this action for wrongful death, the jury returned a verdict for the plaintiff widow for $52,700.00. The defendant has moved the court to set aside the verdict and judgment and grant a new trial on either (1) all issues, or (2) on the issue of damages, on the ground that *180the verdict is excessive and appears to have been given under the influence of passion and prejudice.
