Appeal by defendant from a judgment of the Supreme Court, Queens County (Groh, J.), rendered December 30, 1987, convicting him of murder in the second degree and criminal possession of a weapon in the second degree (two counts), upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by reversing the convictions for murder in the second degree and criminal possession of a weapon in the second degree (one count; third count of the indictment), vacating the sentences imposed thereon and dismissing those counts of the indictment; as so modified, the judgment…
