There was an order granting a new trial after judgment for defendant, and it appeals. The appellee makes a motion to dismiss this appeal, on the ground that it is not taken within the time prescribed by law. In the original case of Walter Brown v. Woodward Iron Company a verdict was rendered for the defendant on March 9, 1909; on a subsequent day of the term a motion was filed to “set aside the verdict and judgment” and to grant a new trial. This motion was regularly continued until June 12,1909, when the verdict of the jury was set aside and a new trial was granted; and it is from this judgment that the appeal is taken.
