The defendant, Harvey S. Traub Client Trust, appellant in this cause, purchased a tract of land containing an excavation in the earth from which gravel had been extracted in the past. After an improvement location permit was obtained, large sums of money were expended in developing the property for mineral extraction. Subsequently, one of the plaintiffs, Pontiac Stone Company, an adjoining property owner, sought a declaratory judgment that the improvement location permit had been improperly issued and was null and void.
