This matter comes before the court upon petition for hearing and for a decree of presumption of the death of J ames Donald Patterson, as provided by the Act of June 7, 1917, P. L. 447, as amended by the Act of April 27, 1927, P. L. 425, and as further amended by the Act of August 5, 1941, P. L. 836, 20 PS §371. The petition also asked for a rule on Char-leroi Savings and Trust Company, trustee durante ab-sentia.
