McCORMICK, Circuit Judge.

The record in this case is meager. Prom the transcript of the record and the briefs of counsel, it appears somewhat doubtful whether the adjudication of the petitioner to be a bankrupt 'was had on his own petition, as a voluntary bankrupt, or on the petition of the C. B. Rogers Company, creditor. The answer recites that on the 16th day of November, 1899, the C. B. Rogers Company, creditor, petitioned the district court to adjudge R. B.
