LATTIMORE, Judge.
Appellant was convicted in the District Court of Reeves County, of the offense of swindling, and his punishment fixed at two years confinement in the penitentiary.
Appellant made a motion to quash the indictment, said indictment being as follows: “In the Name and by the Authority of the State of Texas:
