This is a proceeding in the name of the state, instituted by agents of tbe department of agriculture and industries, for the condemnation and confiscation of “100 sacks, 160 pounds per sack, mill oats and screenings,” under section 2, article 21, of the Agricultural Code of Alabama. Acts 1923, p. 452. The complaint charged that the product described, located on premises of defendant in Birmingham, was being sold, offered, or exposed for sale in this state in violation of section 4, article 20, of the Agricultural Code.
