Jordan, Judge.

M. D. Hall was indicted and tried for the offense of assault with the intent to' murder and was convicted of the offense of shooting at another in the Superior Court of Fulton County. His motion for a new trial on the usual general grounds and three special grounds was denied and he excepts to that judgment.

1. The defendant in his unsworn statement to the jury contended that the shooting in question was an accident. In his statement he said that at the time of the shooting he “had two pair of pants on this arm, I had white shirts under this arm, had the shotgun in this hand,…
