BACKGROUND

Danilo Hernandez appeals from a judgment of conviction entered on April 21, 2000, in the United States District Court for the Southern District of New York (Loretta A. Preska, Judge), following his plea of guilty to one court of conspiracy to distribute and possess with intent to distribute five kilograms or more of cocaine, in violation of 21 U.S.C. § 846. On May 24, 1999, Hernandez pleaded guilty pursuant to a written plea agreement.
