The prosecutions which resulted in the judgment under review are the culmination of an unfortunate controversy between the defendant, J. H. Carroll, and Henry Kehring and his wife, Flattie Kehring, in relation to their occupancy of a dwelling house which is located on a forty-two and six-tenths-acre tract at Glidden, Wisconsin, and was owned and occupied for many years by the Kehrings. In 1937 forty acres of that tract were conveyed to' Carroll by a tax deed, and he believed that the house and other farm buildings were on the forty acres.
