THE COURT.

This is an appeal by the plaintiffs from a judgment in an action to rescind a contract or for declaratory relief, wherein the right to rescind was denied and the rights of the parties declared.

The plaintiffs are the son and daughter of T. B. Gosnell and sue in their capacity as the legally appointed guardians of his estate. On June 17, 1925, T. B. Gosnell was the co-owner with his son and daughter of a one-eighth share of the royalties payable under an oil lease executed in October, 1913,- by Caroline Gosnell and T. B.
