In part one of the information against him in the Circuit Court, the defendant was charged with operating a motor vehicle while under the influence of intoxicating liquor. He was found guilty by the jury. In a trial to the court on part two of the information, the defendant was found to be a second offender and sentence was pronounced. Upon appeal by the defendant to the Appellate Division of the Circuit Court, the judgment of conviction was set aside and a new trial was ordered.
