INTRODUCTION

Well Luck Company, Inc., a wholesale distributor of imported Asian food products, brought the present diversity action against its former customs broker F.C. Gerlach & Company, Inc. following the latter’s alleged mismanagement of a customs transaction. Well Luck asserts causes of action for breach of contract, breach of fiduciary duty, and negligence, and seeks damages.
