The appellants, who were plaintiffs below, sued the appellees upon a note, and to foreclose a mort*121gage on real estate. It is averred in the complaint that on the 6th day of April, 1813, one Samuel Gillespie, who has since died, and the appellee Sarah T. Gillespie, by their promissory note promised to pay Mary J.' Gillispie, three years after date, $1,000, with interest at the rate of six per cent, per annum; that said note is due and remains unpaid; that at the time of the execution of the said note said Samuel Gillespie and Sarah T.
