Appeal from an order of the Supreme Court, Erie County *1462(Frank A. Sedita, Jr., J.), entered June 16, 2009. The order, insofar as appealed from, denied the motion of defendants for summary judgment dismissing the complaints.

It is hereby ordered that the order so appealed from is affirmed without costs.
