The plaintiff Landman, appellee in this court, sued the defendant, the city of Benson; appellant, before a justice of the peace in Douglas county. There was an appeal from the judgment of the justice of the peace to the district court. The plaintiff Landman filed his petition in the office of the clerk of the district court, alleging that the village of Benson had been incorporated as a city of the second class; that on July 18, 1906, while it was yet a village, it had by its agents and servants pumped a large volume of water from a well located about five blocks from the plaintiff’s…
