NEARN, Judge.

Humboldt Housing Authority, a public corporate body politic, created under the Housing Authority Law of the State of Tennessee, entered into a contract with McAdoo Contractors, Inc., for the construction of a certain public housing project in Humboldt, Gibson County, Tennessee. McAdoo subcontracted the plumbing work to complainant, Chester Heglar. After the housing project was completed, McAdoo was paid by the Housing Authority the amount due under the contract less a per diem penalty stipulated in the contract for McAdoo’s failure to complete construction within the time…
