PHILIPS, District Judge.

This is a bill of complaint for a violation of an alleged trade-mark of the complainant, in which it is alleged that the complainant, since the 15th day of April, 1892, has been engaged in compounding and selling a superior quality of spirituous liquors known as “R. H. Parker Rye,” “R. H. Parker Whiskey,” “Parker Rye,” “Old Parker Rye,” and “Parker Bourbon;” and that he has a common-law copyright and trade-mark in the names aforesaid; and that the defendants have improperly and fraudulently used the same in their trade and business.
