MEMORANDUM AND ORDER

NEAHER, District Judge,

Plaintiff, Speed Auto Sales, Inc. (“Speed”), operates an independent Jeep dealership pursuant to a franchise agreement with American Motors Sales Corporation (“AMC Sales”), a wholly owned subsidiary of American Motors Corporation (“AMC”). It claims that defendants have violated sections 1 and 2 of the Sherman Antitrust Act, 15 U.S.C. §§ 1, 2; section 5 of the Federal Trade Commission Act, 15 U.S.C. § 45, the Dealer-Day-in-Court Act, 15 U.S.C. § 1221 et seq.
