Appeal by defendant Robert McGuire from the judgment of the Circuit Court of Texas County, sentencing him to two and a half years' imprisonment in the penitentiary upon conviction of larceny of chickens in the nighttime.

Independently of a verbal admission or confession of defendant, the State's evidence tended to show the following: Trav Johnson, owner of the stolen chickens, and the defendant lived in the country near each other (defendant's evidence indicates a quarter or half a mile apart).
