Before the Court is the Federal Deposit Insurance Corporation’s Amended Motion to Dismiss Counterclaim with Prejudice. The sole issue presented by the Motion is whether the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (FIRREA), 12 U.S.C. § 1821(d), requires a claimant to perform an affirmative action within 60 days following the FDIC’s administrative review in order to continue a claim filed before the FDIC’s receivership.
