VARNER, District Judge.

This proceeding was filed in the Circuit Court of Macon County, Alabama, by the Plaintiff, widow of deceased railroad employee, for employee’s wrongful death in Bullock County, Alabama, while in the course of his employment, allegedly as the result of the negligence of the Defendant Railroad, its servants and agents acting in the line and scope of their authority.
