The plaintiff instituted suit in the Circuit Court of Davidson County for damages for personal injuries sustained about March 31, 1939, ag’ainst the defendant, and his rigid of action is based upon the Federal Employers’ Liability Act, 45 U. S. C. A., section 51 et seq.
The case has been tried twice, the first resulting* in a verdict for the plaintiff in the sum of $10',000’, which was set aside upon motion of. the defendant. Upon a retrial of the case (second trial) the jury returned a verdict for plaintiff for $4,000. The defendant made…
