In 1862 there was a probate sale of the property of Nancy Stevens, by G-eo. W. Catlett, auctioneer. Among the property then sold was the land in controversy in this suit. It was adjudicated to Mrs. Muker for $1275, one third of which was paid in cash, and the balance was represented by her two promissory notes at one and two-years, as prescribed by the court. The auctioneer made.out in due form hisjproctfs verbal of the sale, which was duly signed by Mrs. FI ulcer, but from some cause, perhaps the disorder of the times, he neglected to…
