Appellant, as payee, sued the appellees in the court below, on a promissory note, alleged to have been executed by the decedent, Oliver Johnson, in his lifetime, and the appellee Daniel P. Ingraham, of which note the following is a copy :
“ $500.00. Valparaiso, November 11th, 1872.
“ Thirty days after date, we promise to pay to the order of Henry Schnewind five hundred dollars, together with all attorney’s fees and other costs and charges for the col*249lection thereof, if the same is not paid when due, all without relief from valuation laws, for value received, with interest at ten per cent.…
