Appeal by the .plaintiff, Stark H. Inge, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Kings on the 15th day of November, 1900, upon the decision of the court rendered after a trial at the Kings County Special Term dismissing the complaint upon the merits.

Woodward, J.:
This action was brought to recover broker’s commissions upon the sale of certain property described in the complaint and belonging to the defendant. There is no substantial dispute that the plaintiff entered into a contract with the defendant in respect to a sale of this property, and it is agreed that the amount of the compensation was to be one per cent upon the amount of the purchase price of the property, which was to be $150,00.0.
