MOODY R. TIDWELL, III, Judge:

This case is before the court on defendant’s motion for summary judgment. For the reasons set forth below, the court grants defendant’s motion.

FACTS

This case was filed on February 21, 1990, and was originally assigned to Judge Gibson. On November 3, 1992, it was reassigned to Judge Bruggink.
