CASSIBRY, District Judge:

This matter was tried to the court on November 16, 1981. After carefully considering the pleadings, the evidence, and the arguments of the parties, I enter the following findings of fact and conclusions of law.

FINDINGS OF FACT

At all times pertinent, Alexis Towing, Inc., was a corporation organized and existing under the laws of the state of Louisiana and was the owner and operator of the M/V MISS SUE, an 800 horse power, model-hulled tugboat, 59 feet long and 17 feet wide.
